Patriot Lawn and Pest – Terms of Service & Privacy Policy

By accessing this website or engaging services with Patriot Lawn and Pest (“Company,” “we,” “us,” or “our”), you agree to these Terms of Service and Privacy Policy (“Terms”).
Acceptance of Terms
By agreeing to an estimate, whether verbally, in writing, or electronically, the Customer acknowledges that they have read, understand, and accept these Terms of Service & Privacy Policy.
All services performed and payments made are subject to these Terms. Any work requested or scheduled constitutes acceptance of the Terms by the Customer.
1. Scope of Services
All services are subject to:
- On-Site inspection
- Written estimates or service agreements
- Weather, regulatory, and property-specific conditions
No service, pricing, or result is guaranteed unless expressly stated in writing.
2. Estimates, Scheduling & Change Orders
- All estimates are free and non-binding
- Final scope, pricing, and timelines are governed by written proposals, agreements, or invoices
- Scheduling may be adjusted due to weather, safety, staffing, or operational needs
Change Orders: Services are subject to change orders if:
- Site conditions differ from those observed at the time of estimate
- Hidden, underground, or unforeseen conditions are discovered
- Weather or environmental conditions impact the scope
- Customer requests modifications
Change orders may adjust pricing, scheduling, or materials and may be approved verbally, electronically, or in writing.
3. Payments, Late Fees & Returned Payments
Payment Methods & Timing
- Standard Services: Payment is due at the time of service via check, ACH, debit, or credit card.
- Landscaping Projects: Require 50% down at project start and 50% due upon completion.
- Commercial Contracts: Specific payment terms in commercial agreements supersede standard payment terms.
Secure Payments
- Customers are encouraged to encrypt their payment method through their profile using the PCI-Compliant link provided by Patriot Lawn and Pest.
- If a card expires or requires an update, please contact the office at 918-800-1426 for assistance.
Late Payments
- Any invoice not paid when due may accrue a late fee of ten percent (10%) per month or Twenty Dollars ($20), whichever is greater.
Returned Check / NSF Payments
- Any returned check, declined ACH, or non-sufficient funds (NSF) payment will incur a $100 fee per occurrence.
- Company may suspend services until payment is made with certified funds, cash, or credit card.
- Repeated returned payments may require prepayment for future services.
3A. Recurring Service Term, Renewal & Early Cancellation
Customer acknowledges and agrees that recurring services under this Agreement are provided on an annual service term basis and require advance operational planning, including but not limited to route allocation, labor scheduling, equipment and inventory stocking, materials procurement, and administrative coordination, all performed in reliance on Customer’s commitment to the full term.
Automatic Renewal
- This Agreement shall automatically renew for successive one (1) year terms unless Customer provides Contractor with written notice of cancellation at least thirty (30) days prior to the end of the then-current annual term.
Minimum Notice & Service Obligation
- Customer may terminate recurring services prior to renewal only by providing no less than thirty (30) days’ prior written notice (“Termination Notice”). Customer remains fully responsible for all services scheduled, allocated, or performed during the thirty (30) day notice period, regardless of cancellation, refusal of service, or denial of access.
Early Termination; Pricing Basis Acknowledgment
- Customer acknowledges that discounted recurring service pricing is provided in exchange for Customer’s commitment to the full annual term. If Customer terminates services prior to completion of the annual term for any reason not attributable to Contractor, Customer agrees that Contractor has incurred damages including, but not limited to, route disruption, labor inefficiency, seasonal scheduling loss, and material and inventory commitments.
Early Termination Fee
In the event of early termination, Customer agrees to pay liquidated damages and not a penalty, in an amount equal to the lesser of: (a) Fifty percent (50%) of the remaining unpaid balance of the Agreement for the current term; OR (b) The total value of all services scheduled or reasonably planned during the thirty (30) day notice period, including but not limited to:
- Property Maintenance including Mowing and Landscaping Services
- Weed Control and Fertilization Applications including Lawn Insect Control
- Tree and Shrub Care, Fertilization, and Treatments
- Tree and Shrub Trimming
- Pest Control Applications
- Flower Bed Maintenance and Weed Control Services
Additional Amounts Owed
Upon termination or default, Customer remains responsible for all outstanding balances, approved service charges, applicable late fees, collection costs, court costs, and reasonable attorney fees to the fullest extent permitted under Oklahoma law.
4. Nonpayment; Suspension; Collections Authorization
Contractor reserves the right to suspend or terminate service immediately for nonpayment without waiving any right to recover amounts owed. Customer authorizes Contractor to charge any outstanding balances, approved service charges, late fees, and collection costs to any payment method on file, consistent with this Agreement and applicable law.
5. Limitation of Liability
To the fullest extent under Oklahoma law:
- Company is not liable for indirect, incidental, special, or consequential damages
- Not responsible for weather, acts of God, pre-existing conditions, underground utilities, or conditions beyond control
- Liability, if any, shall not exceed the amount paid for the specific service
6. Indemnification
Customer agrees to hold harmless and defend Patriot Lawn and Pest, its owners, employees, and contractors from any claims, damages, or losses arising from:
- Unsafe property conditions
- Customer negligence
- Misuse of services
- Violation of these Terms
7. Intellectual Property & Job-Site Media
- Website content, logos, images, and branding are the property of Patriot Lawn and Pest
- Any photos or videos captured during service are the sole property of the Company
- Media may be used for marketing, advertising, training, or social media
- Customer will not be compensated for use of images
- No identifying info will be disclosed without consent
8. Mechanical Aeration – Sprinkler & Utilities
- Sprinkler & Septic: Patriot will mark visible sprinkler heads and septic components during mechanical aeration; any sprinkler heads damaged by service will be replaced at no charge.
- Aeration Depth: 1.5–3.5 inches (customary turf service)
- Cable Depth Requirements:
- Standard turf: 6 inches minimum
- Rocky/shallow areas: 24 inches minimum
- Cables in conduit: 18 inches minimum
- Customer Responsibility: Shallow, unburied, improperly buried, or undocumented cables are the responsibility of Customer or original service provider.
- Hold Harmless: Customer agrees to indemnify Patriot for damage to utilities or cables above minimum depths.
9. Rock, Utilities & Excavation Hold Harmless
- Patriot will contact OKIE 811 before any digging operations involving mechanized heavy equipment
- Hand-dug work will not include private utility locating unless requested
- Customer agrees to hold harmless Patriot for damage to:
- Shallow/unburied utilities
- Private lines not marked or disclosed
- Unknown subsurface conditions
- Rock, soil, or debris may require change orders and affect pricing/scheduling
10. Privacy Policy
- Information Collected: Name, email, phone, service address, billing info, communications
- Use of Information: Scheduling, billing, service delivery, internal business operations
- No Sale or Sharing: Customer data is never sold or shared with third parties
- Disclosure Only: Required by law, to process payments, or to protect Company rights
11. No Professional Advice
Content does not constitute legal, structural, engineering, or environmental advice. Customers are responsible for consulting appropriate professionals.
12. Modifications
Company may update these Terms at any time. Continued use constitutes acceptance of changes.
13. Governing Law & Venue
Oklahoma law governs these Terms. Venue for disputes is exclusively in Oklahoma courts.

15. Dispute Resolution / Arbitration
- Any dispute, claim, or controversy arising out of or relating to these Terms or the services provided shall first be submitted to mediation.
- If mediation does not resolve the dispute, it shall be resolved by binding arbitration in Oklahoma, in accordance with the rules of the American Arbitration Association.
- The decision of the arbitrator shall be final and enforceable in any court of competent jurisdiction.
- Each party shall bear its own attorney fees and costs, unless the arbitrator rules otherwise.
16. Warranty Disclaimer
- Except as expressly stated in writing by Patriot Lawn and Pest, all services are provided “as is”.
- No warranties, express or implied, are made regarding fitness for a particular purpose, results, or outcomes.
- Any service guarantees must be explicitly documented in writing.
17. Limitation of Consequential Damages
- To the fullest extent permitted by Oklahoma law, Patriot Lawn and Pest shall not be liable for indirect, incidental, special, or consequential damages, including but not limited to:
- Lost profits, lost revenue, or loss of use
- Property damage not directly caused by gross negligence or intentional misconduct
- Total liability for any claim related to services shall not exceed the amount actually paid by the Customer for the specific service giving rise to the claim
18. Pricing Adjustments
- Service prices may be adjusted annually or as needed due to increased costs of labor, fuel, equipment, materials, products, tariffs, or other operational expenses.
- Patriot Lawn and Pest will provide advance notice of any price changes affecting your account via email, phone, or text message.
- Price changes will apply only to future services; services already performed will be billed at the agreed rate.
- Continued use of services after receiving notice constitutes acceptance of the new pricing.
